Will of Charlotte Hawkins heretofore Hall wife of Holywell House near Bishops Waltham 1939

There follows a transcription of a digital image of a copy of the will obtained from the national archives 13 Feb 2024 [1] Spellings and lack of punctuation have been maintained. Paragraph breaks and bold text have been introduced for ease of reading.

[Note: it is not clear whether any of the bequests were actually received by the stated beneficiaries. The last line of the probate effectively states that her last husband was the only person entitled to inherit and that her Will was ignored by the court - they considered she died intestate.]

This is the last Will and Testament or appointment in the nature thereof of me Charlotte Hawkins the wife of Samuel Hawkins of Holywell house near Bishops Walsham and the county of Hants Esquire in puroucuirt and by foire and virtue and in exercise and exertion of the power or authority given or reserved to me in and by a certain indenture of settlement bearing date on or about the fourteenth day of December one thousand eight hundred & one being the settlement made previous to the marriage between us me and my late husband Benjamin Hall Esquire deceased and every other power and authority whatever in any wise enabling me in this behalf

I do hereby direct and appoint give bequeath and dispose of one equal tenth part or share of the sum of twenty nine thousand nine hundred and fifty eight pounds one shillings and eight pence three per ecutuir reduced Bank annuities mentioned and comprized in the said Indenture of Settlement or other the stocks funds and securities in or upon which the same shall be invested and

the interest dividends and annual produce thereof which shall arrive due from and after my decease unto such person or persons and for such intents and purposes as my daughter Charlotte Berrington the wife of Jenkin Davies Berrington of Woodland Castle near Swansea in the County of Glamorgan Esquire shall notwithstanding her present or any future Coverture by any writing or writings under her hand attested by one or more credible witness or witnesses direct or appoint and for want of such direction or appointment and subject thereto then unto my said daughter Charlotte Berrington for her own sole and separate use and benefit independent and exclusive of her present or any future husband and without being in any manner subject or liable to his control debts or engagements and I declare that the receipt or receipts of my said daughter or of any person or persons appointed by her to receive the said part or share or any part or parts thereof shall notwithstanding her coverture be an effectual discharge or effectual discharge for the same

and I also direct and appoint give and bequeath and dispose of the other and remaining nine tenth parts or shares of the said sum of twenty nine thousand nine hundred and fifty eight pounds six shillings and eight pence three per Coutuir reduced Bank Annuities or other the stocks funds and securities in or upon which the same shall be invested and the interest dividends and annual produce thereof which shall arrive out from and after my decease unto and equally between or amongst my three sons Richard Crawshay Hall Charles Rankon Hall and William Thomas Hall share and share alike as tenants in common and their respective executors admons and assigns and I do hereby further direct and appoint that the portions parts or shares hereby appointed to or in favour of my said daughter Charlotte Berrington and my said sons Richard Crawshay Hall and Charles Ranken Hall respectively shall be vested interests and be payable or transferable upon or immediately after my decease and that the portion part or share hereby appointed to or in favour of my said son William Thomas Hall shall be a vested interest and be payable or transferable upon or immediately after my decease if my said son William Thomas Hall shall then have attained his age of twenty one years but if my said son William Thomas Hall shall not have attained his age of twenty one years at the time of my decease then I direct and appoint that the said portion part or share hereby appointed to him as aforesaid shall be a vested interest only in case and when he shall attain his said age of twenty one years or die under that age leaving lawful issue of his body living at the time of his death provided always and I do hereby further direct and appoint that it shall be lawful for the trustees and trustee for the time being move the said Indenture of Settlement during the minority of my said son William Thomas Hall to levy raise pay and apply any part or parts of the portion part or share hereby appointed to him as aforesaid not exceeding in the whole one moiety equal half part thereof for the preferment advancement or benefit of my said son William Thomas Hall and also to pay and apply all or any part of the interest dividends and annual produce of the same portion part or share in or towards his maintenance and education in such and the same manner as the same trustees or trustee are empowered to do in and by the said Indenture of Settlement

and I do hereby inpurvuaure and by force and virtue and in exercise and exertion of all and every powers and authorities power and authority whatsoever in any wise enabling me in this behalf either under the will of my late father of the Settlements made and executed previous to my marriage with the said Benjamin Hall my late husband or the said Samuel Hawkins or otherwise howsoever give devise and bequeath direct limit and appoint unto my said dear husband Samuel Hawkins his heirs executors admons and assigns all and singular my estate and effects and property whatsoever both real and personal and of every description to which I may be entitled by Settlement or otherwise at the time of my decease (except the legacies hereinafter bequeathed) to hold to him the said Samuel Hawkins his heirs executors admons and assigns respectively according to the nature and tenure thereof absolutely for his and their own use and benefit

and I give and bequeath my dear father’s picture also Sir Thomas Picton’s picture the set of angoulane China and also the diamond ring given me by the late M Hall to my dear son Benjamin Hall Esquire and it is my particular request and desire that the said several articles so bequeathed to my said son shall be considered by him as heirlooms and shall not go out of the family

and I give my pearl necklace with diamond clasp

earrings locket and bracelets to match to my dear daughter the said Charlotte Berrington and it is my particular request and desire that the same shall not be disposed of out of my family

and I nominate and appoint my said dear husband Samuel Hawkins and Charles Allison of Freemand Court Cornhill London gentleman Executors of this my last Will and testament or appointment in the nature thereof and I hereby revoke and make void all former and other will and wills and appointments by me at any time heretofore made and declare this writing only to be and contain my last Will and testament In witness whereof I the said Charlotte Hawkins have to this my last Will and testament or appointment in the nature thereof contained in four sheets of paper to the first three sheets I have set my hand and to this fourth and last sheet thereof my hand and seal this twenty fifth day of March in the year of our Lord one thousand eight hundred and thirty five - Charlotte Hawkins (SS) - Signed sealed published and declared by the said Charlotte Hawkins the Testatrix as and for her last Will and Testament or appointment in the nature thereof in the presence of us who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses Frances Habeoud Lyons G Somerset Place Bath John Lee Servant to Mrs Hawkins Holywell House Hants

On the 20th day of July 1839 admon (with the will annexed) of the goods chattels and credits of Charlotte Hawkins(heretofore Hall widow wife of Samuel Hawkins Esqr.) formerly of Holywell House near Bishops Waltham but late of Shedfield Cottage near Wickham both in the County of ~Southampton dec[eas]ed was granted to Samuel Hawkins Esqr. the husband and Charles Allison Esqr. the executors named in the said will having been first sworn duly to administer - the said Samuel Hawkins Esqr. as the lawful husband of the said deceased being the only person entitled to all her personal estate and property over which she had no disposing power and concerning which she is dead Intestate (as by Acts of Court appears)
